Nature of ChargeThe accused was charged with the offence of absence without leave. This offence is detailed in section 15 of the 1881 Army Act. It is distinct from the greater offence of desertion by the lack of any intention to return.The accused was charged with the offence of "Violence to Superiors" - This is offence is detailed in section 8 of the Army Act of 1881 as being committed by a person who, "Strikes or uses or offers any violence to his superior officer or uses threatening or insubordinate language to his superior officer". The accused was charged with violence to a Senior Officer. The accused was charged under Section 22 of the 1881 Army Act. This Offence is committed by anyone who, "Being in arrest or confinement, or in prison or otherwise in lawful custody, escapes, or attempts to escape". The accused was charged with two charges of offences under Section 40 of the 1881 Army Act. These offences are committed when a person "Is guilty of any act, conduct, disorder, or neglect to the prejudice of good order and Military Discipline".
